ORDINANCE NO. 2025-1

AN ORDINANCE PROVIDING FOR AN ANNUAL TAX LEVY OF THE CLINTON SANITARY DISTRICT, DEWITT COUNTY, ILLINOIS

BE IT ORDAINED, by the Trustees of the CLINTON SANITARY DISTRICT, DeWitt County, Illinois:

SECTION 1: That in addition to the other revenues of the CLINTON SANITARY DISTRICT, DeWitt County, Illinois, there is hereby levied on the taxable property, real and personal, of the CLINTON SANITARY DISTRICT, DeWitt County, Illinois, the sum of $190,000.00 as a general appropriation for the fiscal year ending May 31, 2026, said assessment so levied to be used for the following purposes:

SEWAGE PUMPING, TREATMENT & WATER POLLUTION CONTROL

Corporate $130,000.00

Chlorination $24,000.00

Illinois Municipal Retirement Fund $15,000.00

Social Security & Medicare $21,000.00

Total: $190,000.00

SECTION II: The said levy shall be on the basis of the valuation assessed and equalized for the tax purposes for the said current fiscal year, and the County Clerk of the County of DeWitt and the State of Illinois hereby authorized and directed to extend the tax upon the taxable property of the said CLINTON SANITARY DISTRICT, DeWitt County, Illinois, and the County Treasurer of the County of DeWitt and the State of Illinois is hereby appointed to collect the same, and the assessment by the Assessor of Clintonia Township, in said CLINTON SANITARY DISTRICT, had in said County and State, is hereby accepted and approved by the said CLINTON SANITARY DISTRICT.

SECTION III: That, at a special election held on July 24, 1954, in the said CLINTON SANITARY DISTRICT, DeWitt County, Illinois, a majority of the votes at said election authorized the CLINTON SANITARY DISTRICT to levy for corporate purposes upon property within the territorial limits of the CLINTON SANITARY DISTRICT, DeWitt County, Illinois, in addition to the amount now levied, an additional aggregate amount for which each year shall not exceed an additional .083% of the full fair cash value of said property as equalized or assessed by the Department of Revenue of the State of Illinois.

WRIT OF MANDAMUS

This cause comes before the court on this 26 day of Feb, 2025 with the plantiff, by Taylor & Lynch, LLC, its attorneys, and Defendant, by her attorney, Dan Markwell, and the court having considered the facts, arguments of the attorneys for the parties, and otherwise being fully advised in the premise finds as follows:

  1. This court has jurisdiction of the subject matter hereof and of the parties hereto.
  2. The facts alleged in the Complaint are accepted as evidence.
  3. The parties agree after considering all of the facts and circumstances, that a Write of Mandamus shall issue.

IT IS THEREFORE ORDERED AS FOLLOWS:

  1. The DeWitt County Clerk, Kari Harris, is hereby directed to accept the Tax Levy Ordinance, originally filed in a timely fashion, subject of course to the Clerk's determination of whether said filing meets all applicable Illinois laws, including but not limited to the Illinois Truth in Taxation laws.
  2. This court retains jurisdiction over the parties hereto and the subject matter hereof for purposes of enforcing the terms of this order.
